The website is owned and operated by Fitness Providers LLC (“FP”, “Fitness Providers,” “Company,” “we,” “our,” or “us”). This Privacy Policy (“Privacy Policy”) contains information about FP’s commitment to the privacy of the Users of the website (“you,” “your,” “User”).

This Privacy Policy explains how personal information is collected, used, and disclosed by FP with regard to your access and use of the mobile and desktop versions of the websites located at FitProSvs.com, in email, text, and other communication between you and the Company, and any interactions with FP through third-party social media platforms (collectively, the “Site”) and the services available through the Site (collectively, the “Services”) to individuals, organizations, and businesses (“Clients,” “Customers”). As part of the Services, we may collect, use, and disclose personal information.

1. What is Personal Information?

As used in this Privacy Policy, the term “Personal Information” means information that specifically identifies an individual (including, without limitation, name, e-mail address, household, place of business, username) or information about an individual that is directly or indirectly linked to information that identifies that individual by reference to the identifiers (including, without limitation, names, location data, identification numbers, online identifier, or one or more factors specific to an individual’s physical, physiological, genetic, mental, economic, cultural, educational, commercial, professional, or social identity).

Personal Information does not include “aggregate” information, which is information collected about a group of services or users, or the use of the Site and Services from which individual identities or other Personal Information has been removed. This Privacy Policy in no way limits or restricts the Company’s collection and use of aggregate information.

2. What Personal Information do we collect?

The Site and Services collect two kinds of information from Users: (1) Personal Information that you submit to us, and (2) non-personal information, such as the pages you visited on the Site and your IP address.

We collect and use Personal Information about Users through Active Collection, which is information provided to us, is publicly available about you, or received by us from third-party sources, in the following ways:

  1. Registering on the Site. You supply your Personal Information when you register on the Site. For example, a Client who registers on the Site must provide Personal Information including, but not limited to, full name, address, email address, date of birth, gender, username, password, business name, phone number, interests & activities, schedule availability, fitness background, and photo. We also collect certain health and fitness information from you. We may periodically change the information that is requested from Users and from Clients.
  2. Scheduling and Purchasing Sessions. You may supply Personal Information, including your home address, credit card information, expiration date, authentication code, or similar information, when you schedule and purchase sessions on the Site. We use a third-party company to process credit card transactions, but we may have access to this information.
  3. E-mail and Newsletters. If you submit feedback, questions, or requests for information from or about the Company, we may request your name, mailing address, telephone number, and e-mail address in order to respond to your inquiries. The company may collect and store the information you choose to provide to send you information about FP from time to time.
  4. Promotions, Surveys, Forms, and Search Queries. From time to time, we may request information from you via online promotions, surveys, forms, or search queries. Participation is completely voluntary, and you have a choice whether or not to disclose any information. Information requested may include personal contact information such as your name, phone number, e-mail address, or residential address. This information may be used to contact Users with further information about the Company, to fulfill the terms of the promotion, notify winners and award prizes, or to monitor or improve use and satisfaction of the Site.
  5. Loyalty Programs and Promotional Services. We may gather information from you when you sign up for any loyalty program or other promotional offer made via the Site. As part of those services, you may be required to provide personal contact information such as your name, phone number, e-mail address, or residential address. This information may be used to contact Users with further information about the Company, to fulfill the terms of any scheduling, or to monitor or improve use and satisfaction of the Site.
  6. Mobile Applications. We may collect any of the mentioned Personal Information from Users of mobile devices. When the Company is collecting from Users of mobile devices, the terms of this Privacy Policy remains, unless otherwise noted at the time of collection.
  7. Information about Other Users. We may collect and store Personal Information about other people that you provide to us. If you use the Site to send others (friends, relatives, colleagues, etc.) information that may interest them through our system, we may store your Personal Information and the Personal Information of each such recipient.
  8. Posting and User Contributions. You also may provide information to be published or displayed (“posted”) on public areas of the Site or transmitted to third parties (collectively, “User Content”). Your User Content is posted on the Site and transmitted to others at your own risk. You have the option to set specific privacy settings for this information by logging into your account, however, please be aware that no security measures are perfect or impenetrable. In addition, the Company cannot control the actions of other Users of the Site with whom you may choose to share your User Content. Thus, the Company cannot and does not guarantee that your User Content will not be viewed by unauthorized persons.

We collect and use non-personal information about you through automatic or Passive Collection when you use the Site and Services in the following ways:

  1. Cookies. A “cookie” is a small data file that may be used to collect information about your activity on the Site. For example, when someone visits a page within the Site, a cookie is stored on your hard drive at the request of a website or reads if the User has visited the Site previously.   3. Referrers, IP Addresses, and Environmental Variables. We may collect information through referrers, IP addresses, and various environmental variables. A referrer is information the web browser passes along to the Company web server that references the URL from which you came. An IP address is a number used by computers on a network to identify your computer so that data can be transmitted to you. An environmental variable may include, among other things, the domain from which you access the Internet, the time you accessed the Site, the type of web browser used, the operating system or platform used, the Internet address or the website you left to visit the FP Site, the pages you visit while at the Site, and the Internet address of the website you visit after. We may collect IP address information in order to administer the Site and to gather broad demographic information. Web beacons are small, invisible graphic images that may be used on the Site and Services or in emails relating to the Site and Services to collect certain information and monitor User activity on the Site and Services, such as to count visits, understand usage effectiveness and to tell if an email has been opened and acted upon. 3. How do we use the Personal Information we collect?

The Site and Services collect your Personal Information primarily for the following purposes:

  1. To allow you access to limited-entry areas of the Site;
  2. To process and complete any transactions in connection with the Site and Services, such as to sell you sessions with a fitness provider;
  3. To deliver requested services via the Site and Services, such as sessions or other appointments;
  4. To provide you with notices about your account, such as expiration and renewal notices or to carry out the Company’s obligations and enforce its rights arising from any contracts entered into between you and the Company, such as billing and collection;
  5. To communicate with you regarding partially completed service requests;
  6. To request feedback and contact you about your use of the Site and Services;
  7. To respond to your emails, complaints, requests, questions, comments, and to provide customer service and manage your account;
  8. To analyze and monitor usage and trends of the Site and Services;
  9. To improve and personalize the Site and Services, the Users’ experiences with the Site and Services (such as providing content that matches interests), and to increase the Site and Services’ functionality and user friendliness;
  10. To communicate with you by postal mail, phone, e-mail, and mobile devices or send newsletters about products or services that may be of interest to you, either from us or other third parties;

To alert you of special offers, promotional materials, and other new services from FP or to fulfill the terms of a promotion, as well as updates, confirmations, security alerts, support and administrative messages, and facilitate your use of, and our operation and administration of, the Site and Services;
  12. To provide information to our advisors and representatives (including, but not limited to, our attorneys and accountants) to help us comply with accounting, legal, or security requirements;

  14. To notify you about any changes to this Privacy Policy or the Terms of Use, if necessary, or other updates and important changes to the Site and Services;
  15. To perform background screening, which may include the use of third parties, on service and fitness providers; and
  16. For any other purpose for which the information was collected.
 

3a. Use of Non-Personal Information. We use non-personal information in the ways described above, either alone or in combination with Personal Information. We also may use non-personal information in other ways as permitted by applicable law.

3b. Job applicants. If you submit Personal Information through the Site when applying for a position with the Company, the information will be used solely in connection with considering and acting upon your application. Your Personal Information may be retained for a period of time, but only for the purpose of considering your application for current or future available positions. This information may be shared with other companies for the purpose of evaluating your qualifications for the particular position or other available positions, as well as with third-party service providers retained by us to collect, maintain, and analyze candidate submissions for job postings.

3c. Comments. When visitors leave comments on the site, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service Privacy Policy is available here: https://automattic.com/privacy. After approval of your comment, your profile picture is visible to the public in the context of your comment.

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment on our site you may opt in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

4. With whom do we share the Personal Information we collect?

We may disclose aggregated information about Users, as well as information that does not identify any individual, without restriction.

We will not knowingly share the Personal Information we collect from you through the Site and Services with third parties, except as described in this Privacy Policy or on the Site and Services. These are the ways we may share Personal Information:

  1. With contractors, consultants, vendors, and other service providers (“Service Providers”) who are working with or engaged by the Company in connection with the operation of the Site and Services and who need access to such information to carry out their work for us. For example, we will match and share the personal information of Clients with our list of Service Providers or the ones that the Client has selected. You consent to us providing your Personal Information when you submit a match request through our Site. By sharing this information with Service Providers, it allows them to contact you using the contact information you provided.
  2. We may share your Personal Information with approved contractual partners that fulfill service requests, or that utilize their own Service Providers to supplement our network, all of which are subject to contractual confidentiality restrictions;
  3. Similarly, we will share the Personal Information of Service Providers with Users;
  4. With fitness clubs of Service Providers where you have purchased a session through the Site and Services to fulfill a service or session for you;
  5. To respond to your request or enter you into a promotion. When you email questions to the Company, we may use your email address to process your request and respond to your question.
  6. If you are entering a contest or sweepstakes, we may use your Personal Information in order to fulfill the terms of that promotion. Therefore, we may share the information for prize fulfillment purposes or with mail carriers, as well as with the co-sponsor of that promotion;
  7. To affiliates, third party marketers, agents, subsidiaries, strategic partners, or other unaffiliated parties who are offering products or services that we believe may be of interest to you or who require your name, contact information, or any behavioral or geolocation data that we have collected from you, for research, administrative, or internal business purposes.   8. To independent contractors who help maintain the Sites and Services and provide several administrative services to the Company including, but not limited to, providing customer service, sending customer communications on the Company’s behalf, order processing and fulfillment, maintaining and analyzing data, data entry collection, winner selection, and prize fulfillment for contests and other promotions;
  9. In the case that you post Personal Information selected by you on a public area of our Site, such as a photo, review, or other type of public comments and posts;
  10. We may release information to collection and credit agencies for past due accounts;
  11. To protect against potential fraud, we may verify information collected with third parties and, in doing so, we may receive Personal Information about you from such services. For example, we may be required to use card authorization and fraud screening services to verify that your credit card information and address matches the information that you supplied to secure purchases and registration via the Site;
  12. When you give consent to share your Personal Information, including if we notify you on the Site and Services that the information you provide will be shared in a particular manner and you provide such information;
  13. In an aggregated or anonymized form that does not directly identify you;

  16. To enforce or apply this Privacy Policy, the Agreement, or our other policies or agreements; and
  17. In connection with or during negotiations of an acquisition, financing, sale of company assets, any merger, or in any other situation where Personal Information may be disclosed or transferred as one of the business assets of the Company.
 

You agree to allow your Personal Information to be shared in this manner by registering with the Site and Services. If you do not want your Personal Information shared in this manner, please do not use the Site and Services.

Nothing herein restricts the sharing of aggregated or anonymized information, that may be shared with third parties without your consent, that does not directly identify a User.

5. Links to other websites

The Site and Services may contain links to other websites, including to social media and other third-party websites. Similarly, third party sites may also contain links to our Site and Services.

This Privacy Policy only applies to the collection and use of data by FP. This Privacy Policy does not apply to offline collection of Personal Information or to the websites of other individuals or businesses to which we may provide links. We encourage you to become familiar with third-party privacy policies before disclosing your Personal Information directly to them. We are not responsible for the actions of Service Providers or other third parties, nor are we responsible for any Personal Information you provide directly to any Service Provider, third parties, or Users.

Please be aware that we are also not responsible for the content, policies, or security practices of any other linked or non-linked websites. Any Personal Information that you may provide on the linked pages is provided directly to that third-party and is subject to that third-party’s privacy policy.

6. Security and steps we take to protect your Personal Information online

FP takes the security of Personal Information seriously.

We take reasonable physical, procedural, and electronic measures to implement security procedures to protect the misuse, unauthorized access, loss, destruction, confidentiality, disclosure, or alteration of your Personal Information under our control, including using Secure Sockets Layer (SSL) technology to collect and transmit your information.

We use firewalls to help prevent unauthorized persons from gaining access to your Personal Information.

In addition to taking steps to protect user information online, we also take steps to protect user information off-line.

You are solely responsible for all uses by any person using your password to access the Site and Services. You must keep your password confidential and not disclose it to any other person in order to assist with the protection of Personal Information. You must notify us immediately if you believe your password has been misused or compromised.

7. Privacy of Minors

Our Site is for general audiences. We do not knowingly solicit or collect Personal Information from children under the age of 18 years.

If we are made aware that the Personal Information of a person under 18 years of age has been collected through our Sites or Services, we will take the appropriate steps to delete this information.

We will investigate and take appropriate action to remove the associated Personal Information from our systems.

FP encourages parents and guardians to spend time online with their children by participating and monitoring the interactive activities of minors.

8. Your choices about collection and use of your Personal Information

The Company strives to provide you with choices about the Personal Information you provide on the Site and Services.

You may “Opt-Out” of receiving promotional or marketing emails from us by following the instructions in the promotional emails or by emailing us such a request at: info@FitProSvs.com. By choosing to Opt-Out of any email correspondence, we will process your request to unsubscribe as soon as possible. Please be aware that you may receive a few more messages or promotional emails until the unsubscribe is processed.

If you do choose to Opt-Out, we may still receive non-promotional emails, such as emails about your account, purchased sessions, or any other ongoing business relations. For example, we may send you emails including, but not limited to, notification of changes to scheduling, confirming a scheduling request, information about changes to our Site and Services, and notifications and other disclosures as required by applicable law. In most cases, Users cannot Opt-Out of these communications, however, they will be primarily informational in nature rather than promotional.

If you deactivate your account, you will not have access to sign into our Site or access any of your Personal Information. However, you may open a new account at any time. If you decide to deactivate your account, we may still retain certain Personal Information associated with your account for recordkeeping integrity, analytical purposes, to prevent fraud, collect any fees owed, enforce our Terms of Use, take actions deemed necessary to protect the integrity of our Site or our Users, or to take other actions otherwise permitted by law.

Please keep in mind, if certain Personal Information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

We may not accommodate all requests to change information if we believe the change would violate any law or legal requirement or may cause the information to be incorrect. The Company will respond to all such inquiries within thirty (30) business days.

9. Regional Notices

9a. International Users. We are headquartered in the United States. This Privacy Policy is intended to cover the collection of information on the Site and Services from residents of the United States.

By using our Site and Services, you understand and consent that your Personal Information may be transferred to our facilities in the United States, as well as with those third parties with whom we share it, as described in this Privacy Policy. This Privacy Policy will be subject to the laws of the United States, including the ability of the courts, governments, or law enforcement or regulatory agencies in the United States to obtain disclosure of Personal Information. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your jurisdiction.

If you are located in another jurisdiction, please be aware that once your Personal Information is submitted through our Site and Services, it will be transferred to our servers in the United States. We will protect the privacy and security of Personal Information according to this Privacy Policy, regardless of where it is processed or stored.

Personal Information may be transferred to or accessed by us in the United States or to our affiliates, partners, merchants, or Service Providers who are located worldwide. The Personal Information that we store and retain is generally stored on the Company’s servers located in the United States.

The United States currently does not have uniform data protection laws in place. We will retain Personal Information for as long as necessary to fulfill the purpose for which it was collected, or to comply with legal requirements.

 9b. Your California Privacy Rights. California Civil Code § 1798.83 (California’s “Shine the Light” Law) permits California residents that are Users of the Site and Services to request certain information about the Company’s disclosure of Personal Information to third parties for any direct marketing purposes. California residents may Opt-Out from the disclosure of Personal Information to any third party for marketing purposes. Please be aware that the Company does not disclose any of your Personal Information to third parties for marketing or promotional purposes. 9c. Notice to Nevada Residents. Currently, we do not transfer Personal Information for monetary consideration. If our approach to transferring Personal Information changes in the future, and you would like us not to sell your information, please email us at info@FitProSvs.com at that time with your name, phone number, e-mail address, and mailing address along with the subject line, “Nevada Do Not Sell.”

9d. Notice to Florida Residents. Under the Florida Information Protection Act of 2014 (“FIPA”) Florida residents that are Users of the Site and Services have the right to know the categories of Personal Information collected by the Company and the purposes for which such Personal Information is used (as disclosed in this Privacy Policy). Users may also access or ask for a copy of Personal Information or request deletion of Personal Information by emailing: info@FitProSvs.com. You also have the right not to be discriminated against because you exercised any of your rights under the FIPA. The Company also provides Users with the opportunity to correct the Personal Information if it is incorrect. We will respond to all reasonable requests from Florida residents in a timely manner and in accordance with applicable law. The Company does not sell any Personal Information that it collects.

9e. For our Canadian users. Users rights to access Personal Information are not absolute. We may deny requests for access:

  1. When denial of access is required by law;
  2. When granting access would have an unreasonable impact on other User’s privacy;
  • To protect our Company’s rights and property; or
  1. Where the request is vexatious or frivolous.

10. Changes to our Privacy Policy

FP reserves the right to update or change the Privacy Policy, in its sole discretion, at any time and for any reason. We will alert you of changes made by indicating the date of the last update on this Privacy Policy.

Any modification to this Privacy Policy will be effective immediately upon publication. If you are dissatisfied with any modification to or provision of this Privacy Policy, your only remedy is to terminate your use of the Sites and Services, as described in Section 15 (Termination) of the Terms of Use. Your continued use of the Site and Services after a change or update has been made to the Privacy Policy constitutes your acceptance thereof.

We encourage you to regularly review this Privacy Policy to ensure you understand how any Personal Information you provide to us or collected about you will be used. You are solely responsible for your regular review of this Privacy Policy.

11. Governance

The Privacy Policy and the Agreement will be governed by and construed in accordance with the Laws of the State of Florida, without regard to any principles of conflicts of law.
